Court orders man to compensate wife for denying her sex

A Local Court in Lusaka has ordered a 30-year-old man of Lusaka’s Old Kanyama to compensate his wife with K5, 000 for denying her sex and torturing her for three months.
Before Kanyama Local Court Presiding Magistrate Daniel Phiri was Agnes Chiyanika, 22, of New Kanyama who sued her husband for divorce.
Chiyanika told the court that she only enjoyed the first few days of her marriage and alleged that it was not long before her husband began acting strange.
“Your Honour, our matrimonial home has never known peace from the time we got married in 2013. My husband never used to give me money whenever he got paid and he would beat me each time I asked for money from him,” she said.
She further said that her husband deserted the matrimonial home for three months from August to late October.
Chiyanika said that the landlord chased her out of the house and went back to her parents after defaulting on house rentals as her husband was nowhere to be seen.
“Since the time we started living together, he never at any point mentioned to me that he already had a wife. Your Honour this man you are seeing here also threatens to swallow our only child because of the hurt he has towards him,” Chiyanika submitted.
But her husband, James Chikalumwana made counter allegations of battery at the hands of his wife.
Chikalumwana further alleged that Agnes has been verbally abusing his first wife.
But in his ruling, Magistrate Phiri ordered Chikalumwana to compensate Chiyanika with K 5,000 in installments of K300 per month starting this month end.
